DRINK DRIVING

  • This is an offence under the Road Safety Act 1986.
  • The amount of alcohol a driver can have in his/her system depends on the type of licence held.
  • Motor vehicle licence holders must have less than 0.5 per cent alcohol in their system.
  • Those holding a P Plate licence category or Heavy Vehicle Category licence cannot have any alcohol in their system.
  • For repeat offenders gaol is a real possibility.
  • If you have never offended before, and have held your licence for at least 3 years, and are over 26 years of age then it may be possible to retain your licence if your alcohol reading is less than 0.7 per cent.
  • Otherwise readings of up to 0.9 per cent result in a minimum licence loss of 6 months.
  • Above 0.9 per cent alcohol in your system will result in a longer period of time off the road.
  • In Victoria there is no possibility of obtaining a special dispensation simply to drive to and from work.


DRIVE DISQUALIFIED

  • If you have already lost your licence and been caught driving without a licence the penalties can be very severe and include gaol.


MORE COMMON TRAFFIC OFFENCES


  • Speeding and Careless Driving are very common offences, neither normally results in gaol time, however significant fines and time off the road can result.


What I can do for you

In all cases it is important that the Court gets all the relevant information about you, and knows the circumstances in which any offence took place. Your personal and financial circumstances need to be placed before the Court in an understandable and meaningful way. This means you come to see me at which time I begin the information gathering process. After conferencing with you I speak with police and the Court to ensure your case is ready to proceed on the day listed. At Court if there are to be fines imposed or time off the road these need to be kept to a minimum. The time spent with you preparing your case is essential to minimising penalties.

Unlike many lawyers I only take on one case at a time. That means I only concentrate on your case at Court.
